These Terms of Service ("Terms") govern your use of the MagicMovie.AI platform (the "Service") operated by Nereus Technology LLC ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You represent that you have the legal capacity to enter into these Terms.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use.
MagicMovie.AI is an AI-assisted video creation service. Generated content is produced by combining your inputs, uploaded references, selected media sources, third-party model outputs, licensed stock media, narration, captions, and editing tools. We do not guarantee the accuracy, originality, legal clearance, platform performance, or fitness of any output for a particular purpose.
The Service can also publish on your behalf. If you connect social accounts (through our publishing provider, PostBridge) or your YouTube channel, you authorize us to upload, schedule, post, and set thumbnails on the content you generate, to those accounts, until you disconnect them or revoke access. You are responsible for the content you publish and for complying with each platform's rules.
Paid plans are billed in advance on a recurring basis (monthly or annual, as selected at checkout). Each plan includes a fixed monthly Render Credit allowance. Plan credits reset roughly every 30 days and do not roll over unless we explicitly state otherwise. Annual billing changes the payment cadence, not the monthly credit cadence.
Credit packs are one-time purchases that add Render Credits to your account. Pack credits do not expire and are spent after bonus credits and plan credits. Promotional, referral, and signup credits are bonus credits, have no cash value, are not transferable, and may expire if an expiration is disclosed when they are granted.
Pricing is displayed on the pricing and subscription pages and may be updated with notice. Existing subscribers keep their current paid subscription price through the current billing period unless a change is required by law or payment-network rules.
You may cancel at any time from the account page. Cancellation takes effect at the end of the current billing period; the Service remains available until then. Downgrades and annual-to-monthly changes may be scheduled to take effect at renewal so you keep the access and credits already paid for during the current period. "User Content" means anything you submit to the Service: prompts, reference images, audio, edits, and the resulting generated outputs. You retain ownership of your User Content, subject to the third-party model licenses described below.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content for the purpose of operating, securing, supporting, and providing the Service. We do not sell your User Content.
You are solely responsible for the legality of your prompts and references and for ensuring you have rights to any uploaded material (e.g. photos of identifiable people).
Your use of the Service is governed by our Acceptable Use Policy. Violations may result in immediate account suspension or termination without refund.
The Service integrates third-party providers including, without limitation, Replicate models, ElevenLabs, OpenAI, Pexels, Stripe, Cloudflare, Google, and PostBridge (for social publishing). Third-party model, stock-media, and platform terms may impose additional restrictions on what you may generate, upload, distribute, or commercially exploit. You are responsible for reviewing applicable provider terms when relevant, including for commercial use.
If you connect your YouTube channel, the Service uses YouTube API Services to set thumbnails on your videos. By connecting, you agree to be bound by the YouTube Terms of Service, and you acknowledge that Google's use of your information is governed by the Google Privacy Policy. Our use of YouTube data is described in our Privacy Policy; you can revoke access at any time from your Google Account permissions page.
The Service, its branding, code, design, and documentation are owned by Nereus Technology LLC and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or trade dress.
We may suspend or terminate your access at our discretion if you violate these Terms, our Acceptable Use Policy, or applicable law. You may terminate at any time by closing your account. Provisions that by their nature survive termination (e.g. IP, disclaimers, limits of liability, indemnification) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER NEREUS TECHNOLOGY LLC NOR ITS AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.
You agree to indemnify and hold harmless Nereus Technology LLC from any claims arising out of your User Content, your violation of these Terms, or your violation of any third-party right (including intellectual property, privacy, or publicity rights).
We may revise these Terms from time to time. Material changes will be communicated by email or by a notice on the Service. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the United States, without regard to its conflict-of-laws principles. Disputes will be resolved exclusively in the courts located in the United States.
